WhatsApp is the most used instant messaging app worldwide. This app is very popular among people. Its popularity can be measured by the fact that it has users in every country. The Delhi High Court has recently ruled that WhatsApp chats cannot be considered as evidence in court without a proper certificate. In order to admit any evidence in court, the certificate required under the Indian Evidence Act, 1872 has to be produced.
The decision comes in a case where Dell International Services Pvt Ltd had challenged the Delhi State Consumer Disputes Redressal Commission's order dated December 12, 2023, where the Commission had upheld the July 2023 order of the District Consumer Commission. The consumer court had refused to accept the written reply filed by Dell as it was considered to be delay in filing the reply.
Actually, in 2022 a customer filed a complaint against Dell. Dell was fined by the consumer court for delay in responding to the complaint. Dell said it had not received a full copy of the complaint, delaying its response. To prove this, Dell submitted the screenshot of the WhatsApp chat in the court.
